A 46-year-old landlord is facing felony burglary and assault charges for allegedly arriving at an old tenant's home and assaulting him using a bike lock.
At 5:42 p.m. July 14, a Greeley police officer responded to an alleged assault by 46-year-old Edward Rodriguez in the 1200 block of 5th Avenue.
Upon arrival, the officer, using an online translator, spoke with the victim. The victim reported he heard banging coming from outside his home while trying to sleep.
When he looked outside, the victim said he saw Rodriguez, his previous landlord from a former property, according to the affidavit for Rodriguez's arrest. The victim said Rodriguez told him he was there to collect money the victim owed him.
Rodriguez then began hitting and kicking the victim's vehicle, causing an estimated $500 in damages, according to the affidavit.
The victim said he yelled from inside his home that he was calling the police and also started filming Rodriguez on his phone. Rodriguez then went inside the home without permission and struck the victim with a metal bike lock, arrest records said.
The victim said his hand was struck by the bike lock because he raised his left hand to protect his face from the weapon. After getting struck, the victim said he fell to the floor.
He told police that he escaped Rodriguez and grabbed a knife from the kitchen. Rodriguez responded by telling the victim he was going to call immigration on him and then left the scene on his bike, according to arrest records.
The victim sustained two broken bones in his left hand, police said. A doctor confirmed he suffered serious bodily injury.
The officer attempted to reach Rodriguez at his residence and over the phone but was unsuccessful.
Police saw Rodriguez on July 20 in the 3600 block of 10th Street. During the interaction, Rodriguez admitted he went inside the residence of the victim without permission, the affidavit said.
Rodriguez then said he only hit the victim in self-defense because the victim attacked him with a knife. The video recording that the victim took during the incident, viewed by police, didn't match this story, according to the affidavit.
Rodriguez was booked into the Weld County Jail on suspicion of first-degree burglary, first-degree assault, felony menacing and criminal mischief. He posted a $30,000 bond on July 23, according to online records.
He has an advisement hearing 9 a.m. Oct. 10.
